AB TP-SIU Terms and Conditions for Companies

1. General

1.1. These general terms and conditions of service ("Terms") govern the use of GoSuomiCab (hereinafter "Service Provider") mobile application and/or website service ("Service"). The Application is owned by the Service Provider, which is a limited liability company AB TP-SIU Oy established in Finland:

1.2. Introduction
Welcome to GoSuomiCab! GoSuomiCab (hereinafter referred to as 'the Platform') is a digital platform connecting drivers with passengers in Finland. By registering and using our services, you agree to comply with and be bound by the following terms and conditions.

2. Registration and Requirements

• 2.1. Eligibility: To register as a taxi company on GoSuomiCab, you must submit:
  • A valid taxi license.
  • Proof of insurance.
  • Company details (name, business ID, address, owner, uploaded Trade Registration Certificate PRH, and contact number).
  • VAT number and a valid bank account.
• 2.2. Verification: All submitted documents and information will be verified by GoSuomiCab before approval.
• 2.3. Account Information: You agree to provide accurate, current, and complete information during the registration process and update it to remain accurate, current, and complete.

3. Use of Platform

• 3.1. Car Registration: Once approved, you may add cars to the platform by providing necessary details.
• 3.2. Driver Registration: Companies can add drivers by submitting their:
  • Driver’s license.
  • Taxi driver’s license.
  • Driver’s image, name, and contact number.
• 3.3. Approval Process: All driver registrations are subject to GoSuomiCab’s approval and verification process.

4. Financial Terms

Commission Structure Explanation

GoSuomiCab offers two commission models:

• Standard Model: A flat 17% platform fee applies to all normal trips without promotions.
• Dynamic Commission Model: For trips where GoSuomiCab applies promo discounts (e.g., €3–€5 rider offers), the platform shares the cost by reducing the commission charged to drivers and companies. This lower commission can range from 8% to 16%, depending on the final trip fare.

Why this matters?
This model is designed to support drivers by reducing their cost when the platform is actively promoting rides. It ensures that the platform absorbs part of the promotional cost — not the driver — so drivers still earn fairly, even on discounted trips.

4.3. Payouts: Managed via Stripe/OP/Holvi weekly or on-demand.

4.4. Night Fare Multiplier: 1.2x fare applies between 23:00–06:00 automatically.

4.5. Fee Adjustments: GoSuomiCab reserves the right to modify commission rates fees. Any changes will be communicated at least 30 days in advance via email or in-app notifications.

5. Data Protection and GDPR Compliance

• 5.1. Data Collection: Personal data, including company details, bank account information, and driver details, is collected and processed in compliance with GDPR and securely stored in the EU.
• 5.2. Data Usage: Used for verifying registration, processing payments, and facilitating the platform's functionality.
• 5.3. Data Security: Technical and organizational measures are implemented to secure personal data.
• 5.4. Data Subject Rights: Companies have the right to access, rectify, erase, restrict, or object to the processing of their data, and exercise data portability rights under GDPR.

6. Responsibilities and Obligations

• 6.1. Compliance: Companies must ensure their operations comply with all Finnish laws and regulations.
• 6.2. Insurance and Licenses: Companies must maintain valid insurance and licenses for all registered vehicles and drivers.
• 6.3. Driver Conduct: Companies are responsible for ensuring their drivers act professionally, maintain punctuality and courtesy, and adhere to Finnish traffic laws and GoSuomiCab’s platform standards.

7. Limitation of Liability

• 7.1. GoSuomiCab acts solely as a platform provider and is not liable for disputes, damages, or claims arising between the company, drivers, or passengers; service interruptions; or technical issues beyond its control.
• 7.2. Companies indemnify GoSuomiCab against any claims arising from their operations or use of the platform.

8. Termination

• 8.1. GoSuomiCab reserves the right to terminate or suspend a company's access to the platform for violations, including providing false registration information, repeated non-compliance with Finnish regulations, or failing to maintain valid insurance or licenses.
• 8.2. Companies will be notified of termination with an explanation of the violations.

9. Amendments

• 9.1. GoSuomiCab reserves the right to amend these terms. Updates will be communicated via email or app notifications.
• 9.2. Continued use of the platform constitutes acceptance of the revised terms.

By using GoSuomiCab, companies and their drivers agree to these terms and conditions. Please ensure that you have read and understood them before registering on our platform.
